Prescribed By-Laws

In addition to house rules and guidelines, below are by-laws approved in AGM and/or MCST:


FEES FOR 2nd CAR PARKING

“ THAT an amount of $50.00 per month, collected in a 3-monthly basis to allow 2nd cars to be parked in the estate, subject to availability of car park lots. The management council whose decision shall be final shall determine the number of car park lots available for parking of 2nd cars.”

FEES FOR 3rd and 4th CAR PARKING

“ That an amount of $90.00 per month be collected to allow 3rd and 4th cars to be parked in the estate, subject to availability of car park lots. The management council whose decision shall be final shall determine the number of car park lots available for parking of 3rd and 4th cars.”

FEES FOR MOTOR CYCLE PARKING

“ THAT an amount of $25.00 per month be collected to allow 1st motor cycle, which is used as a second vehicle to be parked in the estate, $25.00 per month be collected to allow each subsequent motor cycle to be parked in the estate and subject to availability of motor cycle parking lots. The management council whose decision shall be final on the allocation of motor cycle parking lots.”

BY-LAW GOVERNING ILLEGAL PARKING

"The Management may without notice, cause any vehicle parked in the estate:
A. Without a valid transponder or
B. Without a valid parking permit issued by the Management or
C. Found parked in a lot other than a designated lot in areas not drawn as parking lot.

To be towed away or wheel-clamped and the cost of removal (including the administrative fees of $100.00, excluding GST) shall be borne by the owner of the vehicle so removed or clamped.”

Existing By-law
Item 2- The management may without notice, cause any vehicle without a valid transponder or found parked in a lot other than a designated lot in areas not drawn as parking lots to be towed away or clamped down and the costs of removal (including administrative fees of $100.00, excluding GST) shall be borne by the owner of the vehicle so removed or clamped.

Item 3- Any vehicle that is parked in the basement must display, at all times, a valid car park transponder issued for that vehicle, otherwise one or more of its wheels will be immobilised by a wheel-clamping device.

OVERNIGHT PARKING

With effect from 1st April 05, visitors intending to park their vehicles overnight in Tropical Spring are required to apply at the management office or guardhouse for an overnight parking slip. This will permit the vehicle to be parked overnight at Tropical Spring up to 11.59pm of the next day. Only one such overnight parking will be issued to each visitor vehicle per calendar week. Each calendar week starts from Sunday. This is subject to approval from the Management Office.

Visitors are required to display the overnight parking advice slip prominently at the vehicle’s dashboard, falling which the car would be considered as illegal parking. Kindly note that visitors are allowed to park their vehicles only at the visitors’ carpark areas i.e. at either visitor lots no. 93 to 100 or 104 to 107. If these visitors’ lots are full, visitors are advised to park their vehicles at the public car parks in the neighbouring housing estates.

FALLING WINDOW LAW AND GLOBAL WINDOW INSPECTION (GWI)

Under the BMSMA, when a window falls, the owner has to prove to the court that he/she has maintained his/her windows failing which he could be fined up to S$10,000 or jailed up to 12 months. A leaflet entitled “Warning – Your falling window can land you in JAIL!” giving full details of the new law is attached for your reference.

LANDSCAPE VANDALISM

We would like to forewarn that nobody is allowed to vandalise or cause damage to the common property and refer you to Clause no.4 of the Prescribed By-Laws, Second schedule of the Building Maintenance And Strata Management Act as follows:

“4. A subsidiary proprietor or an occupier of a lot shall not, except with the prior written approval of the management corporation or as permitted by an exclusive use by-law made under section 33 of the Act for his benefit –

A. Damage any lawn, garden, tree, shrub, plant or flower being part of, or situated on, the common property; or
B. Use for his own purposes as a garden any portion of the common property.”

PARKING OF BICYCLES WITHIN THE ESTATE

Kindly note that children bicycles of 37cm wheel diameter wheel are not to be parked in the common area, especially behind the cars as that could potentially pose a safety issue.

MOSQUITOES ISSUES
We noticed that there are many residents who have potted plants placed at the planter boxes. We would appreciate if you could look out for stagnant water at the following areas and make sure that they are kept dry and clean:
· Receptacles holding your potted plants.
· Areas at your air-con ledges.
· Items in your house e.g. vases, pails, empty containers etc.

CAR WASHING BY-LAW (REVISED CIRCULAR)

“To prohibit the washing of all vehicles in any locations other than the allocated car washing bays or in other location as determined by the management, and impose an administrative charge of $50.00 for non – compliance.”

The intentions of the by-law are:-

To stop the detergents being used for car washing from damaging the grass of the aerated slabs parking lots. This may cause water logged thus become potential mosquitoes breeding ground.
To avoid detergents being used for car washing be accumulated on the cement floor areas, which will cause danger to residents, especially during raining seasons.
To avoid water accumulated on the cement floor areas, which will become potential mosquitoes breeding ground.

Therefore, the management wish to clarify that the following rules shall be used in the execution of the By-Law:-

Washing of all vehicles is strictly prohibited at the “aerated slabs parking lots” within the Tropical Spring compound.
Washing (use of detergents and alike) of all vehicles is prohibited in the “sheltered car park area”, except for the allocated car washing bays.

The management had earlier reviewed the car cleaning service (Super Dini Wash Service) engaged by the SPs. This cleaning agent is allowed to use WATER ONLY to clean/mop the cars, and is REQUIRED TO DRY THE FLOOR should he wet the cement flooring. In addition, the company is allowed to enter the Estate on every Monday and Friday night only, and is required to pay for the water usage to the Management on a monthly basis.

As such, the Management has considered Super Dini as an approved agent, which is allowed to offer his service using water at locations other than in the allocated car washing bays, but not at the aerated slabs parking lots areas.


PLAYING BALL GAMES, BADMINTON ETC. AT DRIVEWAY AREA

We noticed some residents and children playing ball games, badminton, learning to cycle etc. at the driveway area around Tropical Spring. There are blind spots along the driveways and accidents may occur should motorists fail to see the people at these areas.

PLACING SHOE CABINETS, POTTED PLANTS, BICYCLES ETC. OUTSIDE MAIN DOOR AREA

Please be informed that residents are not allowed to put their personal belongings at the common property except with the approval by the Management. It is stated in the BMSMA (2004) of the Second Schedule Prescribed By-Law Clause 3(1) of the following:-
“A subsidiary proprietor or an occupier of a lot shall not obstruct the lawful use of the common property by any person, except on a temporary and non-recurring basis.”

The following are guidelines given by SCDF on placing items at the common area:-
· No storage of combustible materials in common circulation areas and exit passageways.
· No placement of bicycles and items that can easily topple. Strictly not permitted along escape routes.
· Strictly no items are allowed to be placed within exit staircases at all times.
· Only single shoe racks are tolerable only for the sole purpose of keeping shoes, whereby, it would not constitute a substantial fire load.
· To maintain a clear escape passage of 1m clearance where the shoe cabinet is placed.
· Shoe cabinet should not project above the parapet wall height whereby it can effect the ventilation of the escape passages.

Only 1UNIT of MOVABLE shoe racks with dimensions approximately Length(90cm)x width(60)xHeight(30cm) is allowed to be placed outside your unit.
